1.  What is Decline Certificate NADRA? 

If an application for issuance of Succession Certificate or Letter of Administration by legal heirs of deceased regarding movable and immovable properties of deceased cannot be processed by NADRA due to any reason, the NADRA issues decline certificate to the applicant. 

 

2. Decline Certificate Nadra meaning in urdu

 In urdu, decline certificate may be called مستردگی سند یا مستردگی سرٹیفکیٹ .

Decline is just like a refusal. In this case, decline certificate NADRA is written refusal by NADRA to process the application for succession certificate or letter of administration.

 

3.  Types of Decline Certificate 

Usually, Decline Certificate NADRA is of two types one is Pre-Processing Decline Certificate and second is Post-Processing Decline Certificate.

 5. Reasons for issuance of Decline Certificate

·        For obtaining succession certificate or letter of administration, providing biometrics by all the legal heirs is the mandatory requirement. In case, biometrics of all the legal  heirs are not provided or NADRA is unable to verify the biometrics or unable to inquiring details,  Decline Certificate may be issued.

·        If any dispute exists among the legal  heirs of deceased regarding tile over the properties of deceased and matter is pending any court of law, in this case too, decline certificate may be issued. 

·        If all the assets or properties of the deceased are not located in the jurisdiction of this Province/Federation.

·        If NADRA has no record of the deceased and therefore his/her Identity cannot be verified by NADRA itself.

·        If all the legal heirs are not major rather one or more legal heirs are minor(s), this is the cause for issuance of  decline certificate.

·        If one or more legal heirs are special persons means he/she or they are mentally disabled.

·        If original documents of properties/ assets of deceased are not provided to NADRA by applicant or same have been reported as missing.

·        If NADRA is unable to resolve the case  because of the reason that the case requires adjudication by civil court.

·        If  after publication in newspaper or otherwise, any other legal heir who was not mentioned by applicant during his application for issuance of succession certificate  / letter of administration, approaches the NADRA  and raises objection that he/she is also legal heirs of deceased and also  entitled in the properties of deceased, in such case, decline certificate would be issued.  

 

6. Decline Certificate NADRA Fee 

Before  understanding fee of decline certificate, lets understands about fee for issuance of Succession Certificate/ Letter of Administration. NADRA charge Rs. 20,000/- for issuance of if value of property of deceased is more than Rs. 1,00,000/-, however, fee of NADRA reduces from Rs. 20,000/- to Rs. 10,000/-, if value of property of deceased is less than Rs. 1,00,000/-. So, two types of fees are associated for issuance of succession certificate / letter of administration.

                                    

Pre-processing decline certificate fee 

Earlier, no fee was charged by NADRA for issuance of Pre-processing decline certificate  but currently, NADRA is charging Rs.15,000/- for issuance of pre processing decline certificate as the value of properties of deceased unusually exceeds Rs. 1,00,000/-

 

Post-Processing decline certificate fee

After starting process for on your application for Succession Certificate/ Letter of Administration, at any stage, NADRA refuses your request due to any reason, it refunds only Rs. 5000/- from the amount you paid to NADRA.

  

7. How to get decline certificate from Nadra?

 

For obtaining, pre processing decline certificate, you are required to file an Application for issuance of pre processing decline certificate,  to Incharge SFU mentioning therein valid cause.

  1. Copy of your (applicant) CNIC/NICOP/POC
  2. Copy cancellation certificate of CNIC of Deceased CNIC issued by NADRA
  3. Copy of Family Registration Certificate (FRC) issued by NADRA
  4. Copies of supporting documents such as ownership proof of properties of deceased to establish jurisdiction (if applicable)
  5. Any other document, required by NADRA.

For obtaining Decline Certificate, you can apply in that designated offices of NADRA, which had jurisdiction to process for your application for Letter of Administration or Succession Certificate if you were eligible.

Why to get a Pre-processing Decline Certificate?

There are number of reasons as mentioned in this article, due to which NADRA does not issue Succession Certificate/ Letter of Administration, if any of these reasons applies to your case, you can file application for obtaining Pre processing Decline Certificate.

Will NADRA issue a Decline Certificate in case biometrics of all the legal heirs is not provided to NADRA?

Yes. Even if biometrics of just single heir is not provided to NADRA, it shall be the cause of issuance of decline certificate.

What to do after obtaining Decline Certificate?

After obtaining, decline certificate, you can approach to Civil Courts for filing two different cases (1) Application for Succession Certificate regarding movable properties of deceased (2) Suit for declaration of legal heirs regarding immovable properties of deceased.

Does an objection by any of the legal heirs to the issuance of succession certificate lead to the issuance of decline certificate?

Yes, in case any legal heir raises objection to the issuance of Succession Certificate, it may result into issuance of a decline certificate.
